    1. Acceptance of these Terms

    By accessing or using Fumoshare, creating an account, or uploading content, you agree to be bound by these Terms of Service, our Community Rules, and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the service.

    2. Eligibility and Your Account

    You must be at least 13 years old to use Fumoshare. You may not use the service if you have been permanently banned for a serious violation of our rules or if you are barred from using the service under applicable law. You are responsible for the activity that occurs through your account and for keeping access to your linked authentication providers secure.

    3. Your Content and License

    You retain ownership of the photos and content you upload. By posting on Fumoshare you grant us a non-exclusive, royalty-free, worldwide license to host, store, display, resize, optimize, and feature approved public posts on our official community channels such as Discord, Telegram, Bluesky, and X. This license ends when you delete the content or your account, except where retention is required by law. You are solely responsible for the content you upload and confirm that you have the rights necessary to share it.

    4. Acceptable Use

    You agree to use Fumoshare only for lawful purposes and in accordance with our Community Rules. You must not upload content that infringes the rights of others, attempt to gain unauthorized access to the service, scrape or harvest data, interfere with the normal operation of the platform, or use bots or automation to inflate engagement.

    5. Community Rules

    Our Community Rules form an integral part of these Terms. They describe the content and behavior we allow, how content is moderated, and the consequences of violations, which may include content removal, warnings, suspension, or a permanent ban.

    6. Third-Party Services and Authentication

    Fumoshare relies on third-party authentication providers (Discord, Google, and LINE) and on external infrastructure and delivery services described in our Privacy Policy. Your use of those services is also governed by their own terms and policies. We are not responsible for the availability or practices of third-party services.

    7. Copyright and Intellectual Property

    We respect the intellectual property rights of others. If you believe that your copyrighted work has been used on Fumoshare without authorization, report it to the staff through our official Discord server with enough detail to identify the work and the specific content. We will review the report and remove content where appropriate. Accounts that repeatedly infringe intellectual property rights may be suspended or terminated.

    8. Availability, Changes and Termination

    Fumoshare is provided on an as-is and as-available basis. We may modify, suspend, or discontinue all or part of the service at any time, and we may suspend or terminate your access if you breach these Terms or our Community Rules. You may stop using the service and delete your account at any time through the Privacy page.

    9. Disclaimers

    The service is provided without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, secure, or free of errors, or that user content will be accurate or appropriate.

    To the maximum extent permitted by applicable law, Fumoshare and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

    You agree to indemnify and hold harmless Fumoshare and its operators from any claims, damages, liabilities, and expenses arising from your use of the service, your content, or your violation of these Terms, our Community Rules, or the rights of any third party.

    These Terms are governed by the laws of the European Union and of the member state in which the data controller is established, without prejudice to mandatory consumer protection provisions of your country of residence. Any dispute will be handled by the competent courts under applicable law.
